These terms and conditions governs your use of our website located at http://paperpoint.com.au/ ("Website") including the purchasing of goods and forms a binding contractual agreement between you, the user of the Website and us, Kestrel Retail Pty Ltd (ACN: 604 399 724) as trustee for Kestrel Retail Holding Trust  (trading as Paperpoint, hereby “Paperpoint”)

By using the Website you acknowledge and agree that you have had sufficient chance to read and understand the terms and conditions below and you agree to be bound by it. If you do not agree to its terms, please do not use the Website.

Orders and pricing

We are not obliged to accept orders received through our Website and any order which is placed will be subject to the availability of the goods ordered.

Payment & Currency

Unless stated otherwise the prices listed are exclusive of GST. If your order is shipped internationally then you may be subject to other duties and charges for which Paperpoint will not be liable.

Please note that a reference to an amount of money on the Website is a reference to the amount in the Australian currency.

Delivery

It may take up to 3 business days for your order to be delivered. We are happy to provide an estimated delivery time but we do not accept liability for late delivery or non-delivery.

We will try to ensure that each order safely and securely packed having regard to the fragility of the goods. If you receive goods which are damaged please notify us immediately. Please keep the goods in the original packaging and return to us.

Depiction of goods/Colour

The depiction of goods and the colours displayed on the Website are only a guide. Please note that colours of some products may vary depending on the resolution and quality of the monitor or device the Website is accessed through. If you have queries about the colour or depiction of a product, please contact us prior to ordering.

Refund and returned goods

We do not usually provide refunds if you change your mind or make the wrong decision. You may choose between a refund , exchange or credit where goods contain faults, have been incorrectly described, are different from a sample shown or do not do what they are supposed to do. 

If we do process a refund for change of mind or wrong decision, there will be a restocking fee of 5% to cover the costs of the web order.  Additionally you will need to pay any shipping fees to return the item(s).

License to use Website

We grant you a non-exclusive, worldwide, non-transferable license to use the Website in accordance with these terms and conditions.

You may access and use the Website (including any incidental copying that occurs as part of that use) in the normal manner and may also print one copy of any page within the Website for your own personal, non-commercial use.

The Website may contain links to other websites as well as content added by people other than us. We do not endorse, sponsor or approve any such user generated content or any content available on any linked Website.

Intellectual Property Rights

Nothing in this Agreement constitutes a transfer of any intellectual property rights. You acknowledge and agree that, as between you and us, we own all intellectual property rights in the Website.

All content and material on the Website is owned by Paperpoint and subject to copyright and should not be used by anyone else without the express written consent of Paperpoint.

Australian Consumer Law

Nothing in these terms and conditions shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law (including the Competition and Consumer Act 2010) and which by law cannot be excluded, restricted or modified.

Liability

To the full extent permitted by law, we exclude all liability in respect of loss of data, interruption of business or any consequential or incidental damages. To the full extent permitted by law, we exclude all representations, warranties or terms (whether express or implied) other than those expressly set out in these terms and conditions and in the case of goods limit our liability to the replacement of the goods or the supply of equivalent goods; the repair of the goods; the payment of the cost of replacing the goods or of acquiring equivalent goods; or the payment of having the goods repaired.

Amendment

These terms and conditions shall not be amended except in writing agreed between the user and Paperpoint.
